Neil McCarthy, 25, of Oregon, was arrested and charged with indecent exposure in connection with the July 3 incident, as reported by the U.S. Attorney’s Office for the Western District of New York. Following an initial court appearance, McCarthy was released on his own recognizance.

According to federal prosecutors, a flight attendant observed McCarthy exposing himself and urinating during the flight, and a passenger even managed to capture a photo of the act. The plane was diverted to Buffalo Niagara International Airport, where McCarthy was arrested upon arrival at Gate 2.

In a statement to the authorities, McCarthy admitted to drinking heavily throughout his journey, consuming several “Jack and cokes” before boarding his initial flight in Portland. He claimed that he was returning from the restroom when the incident occurred, attributing his actions to a medical urination problem, as detailed in the criminal complaint filed in Buffalo federal court.

Following the incident, McCarthy was escorted off the plane and arrested. He now faces charges of indecent exposure, which carry a potential penalty of up to six months in prison and a $5,000 fine.
